Identical bills (H.B. 2407/2449) in the West Virginia Legislature to provide owners of antique motor vehicles with a fair and equitable personal property tax assessment have been introduced and referred to the House Roads and Transportation Committee. The bills seek to address recent unfair valuation practices which have negatively impacted many West Virginia hobbyists.

We Urge You to Contact Members of the House Roads and Transportation Committee (List Attached) Immediately To Request Their Support for H.B. 2407/H.B. 2449

West Virginia law defines an "Antique motor vehicle" to mean any motor vehicle which is more than twenty-five years old and is owned solely as a collector's item.

H.B. 2407 and H.B. 2449 provide that for the purposes of the property tax, the assessed value of an antique vehicle cannot exceed $200.

So this is another bill that subsidizes drivers of a certain class of vehicles at the cost of other tax payers in the state?

No. What it does is create a peak of what hobbyists can be assessed for their collector vehicle. Standards were used prior to the introduction of this legislation that were unfairly fleecing them.

How so?

Do you care to post the existing standards with which existing tax rates are set so we can have an informed discussion?

so antiques and collectibles go up in value as time increases, yet the tax assessment on those rising values goes down? hardly fair. the higher the value, the higher the tax should be.

I say that for a lot of things I buy knowing there's a tax on. So yup.

You see I'm not a liberal who thinks I'm special and should get a break or be entitled to something..

same thing wiht property taxes, you know if you buy a more expensive house your taxes will be higher. So do you buy a dump or do you suck it up and pay higher taxes for something you like?

The issue is they tax accessments were not being done in a fair, subjective, standard.

judging from waht i see on barrett jackson i'd say greatly under estimated.

Are you ever going to post the state law as it currently stands so we can have an informed discussion on the issue?

As of now, we only have your word that they're currently being over-estimated.
After doing a bit of research, it seems like the current law is actually pretty fair.

"All property in the state is valued using the three generally accepted approaches to value, those being cost, income and market, when applicable. For vehicles in the state, the lowest book value from NADA is recognized as market value for property tax purposes."

Frequently Asked Questions

The lowest book value from NADA on older cars is going to be pretty low. Why do cars in certain categories need a fixed exemption from the standards everyone else must follow?
